Welcome to the Jungle. The purpose of the small claims court system is to allow people to resolve their disputes themselves without paying the fees of an attorney. The rules of small claims courts are different from county to county in Indiana, and sometimes from township to township. In some situations, the system works well and individuals are able to obtain a fair result. In others, individuals feel lost or overwhelmed by the court process, especially if the other party is represented by an attorney. Any business organization is required to be represented by an attorney if the matter in controversy involves over $1,500. My advice is to at least speak to an attorney before your scheduled hearing to decide whether you should proceed on your own, and if so, how to do so.
